These Terms govern your use of Habivista (habivista.com), a service operated by Azunus Realty Consult ("we"). By creating an account or using the service, you agree to these Terms.

1. Eligibility

You must be at least eighteen and able to enter a binding contract under Ghanaian law.

2. Accounts

Keep your login details secure and accurate.
You are responsible for all activity on your account.
One account per person or entity; duplicate accounts may be merged or removed.
Agency accounts must be tied to a real Ghana Real Estate Authority licence number where applicable.

3. Listings

Only list properties you are authorised to advertise.
Information must be accurate — including price, size, address range, and media.
Rental listings must comply with the Rent Act, 1963 (Act 220) — including the six-month advance limit.
Listings must comply with our listing standards and our acceptable use policy.
We may remove listings that violate the Terms, this policy, or applicable law.

4. Verification

Verification badges reflect what we have checked (identity, agency, ownership) at the time of review. They are not a warranty — you are still responsible for your own due diligence before money changes hands.

5. Prohibited conduct

Scams, fraud, misrepresentation of property or identity.
Scraping, reverse engineering, or automated access outside our published APIs.
Harassment, hate speech, or illegal content.
Circumventing platform fees on inquiries that originated on Habivista.
Discrimination against tenants or buyers on prohibited grounds.

6. Payments

Plan fees are billed as stated at checkout. All amounts are inclusive of applicable taxes where shown. Refunds follow the refund policy; raise a dispute with us before issuing a chargeback.

7. Liability

We provide the marketplace "as is". We are not a party to the rental or sale agreement between users. Our aggregate liability is limited to the fees you paid us in the twelve months preceding the claim.

8. Indemnity

You agree to indemnify Habivista against losses arising from your breach of these Terms, your listings, or your use of the service to harm others.

9. Account suspension & termination

We may suspend or terminate accounts that breach these Terms or applicable law. Where possible we give notice and an opportunity to cure; for severe breaches (fraud, scams, illegal listings) we may act without notice.

10. Dispute resolution

If a dispute arises, please first raise it with support@habivista.com. Unresolved disputes are subject to mediation under Ghana's Alternative Dispute Resolution Act, 2010 (Act 798) before any court action.

11. Changes

We may update these Terms. Material changes are notified by email at least fourteen days in advance. Continued use after the effective date constitutes acceptance.

12. Governing law

These Terms are governed by the laws of Ghana. Disputes are subject to the courts of Accra.
